1. THE PARTIES AND SUBJECT OF THE CONTRACT
PARTY
This Membership Agreement (“Agreement”); Megaton Medya Sanayi ve Ticaret Ltd.Şti (“Digitalcart”), which is the owner of digitalcart.com and has a residence at the address “Musalla Bağları Mah.Şehit Ahmet Değer Sok.No:11-604 Selçuklu/Konya”, and digitalcart.com and the website ( “Platform”) has been concluded between the individual/corporate member ("Member") of the website, who has become a member by accepting the following conditions, to determine the conditions for the Member to benefit from the Services offered by Digitalcart.
Digitalcart and the Member will be referred to as the "Party" separately and together as the "Parties" in this Membership Agreement.
SUBJECT
The subject of this Agreement is to determine the terms of use of the Member from the website ofdigicart.com owned by Digitalcart.
2. DEFINITIONS:
SELLER: Refers to the legal person who offers or sells the goods or services subject to electronic commerce through the Platform.
BUYER: Refers to the natural or legal person who purchases the product or service subject to electronic commerce through the Platform or acts for the purpose of purchasing.
SERVICE PROVIDER: Refers to real or legal persons engaged in electronic commerce activities.
INTERMEDIATE SERVICE PROVIDER: Refers to the real or legal persons who provide the electronic commerce environment for the economic and commercial activities of others.
PERSONAL DATA PROTECTION POLICY: The digitalcart.com platform, which regulates the general privacy policy of Digitalcart regarding personal data, including for what purposes and how the personal data transmitted by the Members through the Platform will be used by Digitalcart. MEMBER ACCOUNT PAGE: The Member can perform the necessary transactions in order to benefit from the various applications and Services on the Platform, enter his personal data and information requested on the basis of the application, only the user name determined by the relevant Member and Refers to the page with a User-specific nickname that can be accessed with a password.
SERVICES: Refers to the applications put forward by Digitalcart in order to enable the Members to perform the business and transactions defined in this Membership Agreement.

MEMBER: Membership agreement on digitalcart.com page refers to real persons who have accepted the privacy notices and become “Individual/Corporate” members.
USER / VISITOR: refers to the people who visit the digitalcart.com page without being a member of the site.
INDIVIDUAL/CORPORATE USER: refers to the people who shop using the digitalcart.com page without being a member of the site.
3. RIGHTS AND OBLIGATIONS OF THE PARTIES
In order to gain membership status, the user who wants to become a Member must approve this Membership Agreement on the Platform, fill in the information requested here with correct and up-to-date information, and the Membership application must be evaluated and approved by Digitalcart. The user who wants to become a member must be over 18 (eighteen) years old. With the completion of the approval process and notification to the Member, the Membership status begins and thus the Member attains the rights and obligations specified in this Membership Agreement and the relevant parts of the Platform. The Member, who does not provide accurate and up-to-date information while filling out the said Membership Agreement, is personally responsible for all damages that may arise due to this. The cancellation of the Membership by contacting our company from the contact information in the communication section of the Membership status does not mean the cancellation of the approval given for sending commercial electronic messages. If there is a dispute about who owns the membership rights and obligations and the said persons make a request from Digitalcart in this regard, in case of more than five payments made to Digitalcart for any Service using the relevant Membership account, the last five payments, in case of less, all of the payments made. The person who makes the majority will be deemed to be the owner of the Membership account and action will be taken accordingly.
If the Member wishes to initiate any legal action or purchasing process regarding the campaigns and/or advertisements viewed on the Platform, he/she must fulfill all necessary legal obligations and legal procedures, including those on the Platform, As Digitalcart, it accepts and declares that it does not have any information and responsibility.
In the transactions and correspondence carried out on the Platform, the Member shall comply with the provisions of this Membership Agreement, all the conditions specified on the Platform, in force.
